Taxi Cab New Lease Agreement in Hamilton: Limited Interest Transfers

How a plate owner temporarily hands a limited interest in a taxicab licence to someone else.

A taxi cab lease agreement, also called a limited interest agreement, is how a plate owner lets someone else run their licence for a time without selling it. The plate does not change hands and the ownership record does not change; what moves is a limited interest, temporarily. The City registers that arrangement, and it wants the vehicle documentation to match on the day it does.

The City of Hamilton lists this under its “Mobile” category: “Lease agreement means a written agreement wherein a limited interest in a licence is temporarily transferred by a taxicab owner.”

Who needs this licence?

A lease agreement means a written agreement wherein a limited interest in a licence is temporarily transferred by a taxicab owner. Two parties are therefore involved: the owner who holds the plate, and the person taking on the limited interest for a period.

This is not a sale and it is not a transfer of the plate. Where a taxi cab owner transfer moves the licence permanently to a new holder, with a transfer form recording the value of the transaction, a lease leaves ownership where it is and lends out a limited interest.

It is also not a driver licence. Anyone driving the cab still needs a taxi cab driver licence in their own name, and the definition of a taxicab driver includes an owner who drives. The lease deals with the licence interest; the driving is licensed separately.

What documents do you need?

Four items, and the file is really a snapshot of the vehicle at the moment the arrangement begins.

The Lease Agreement form is completed first. It is the City's record of the limited interest arrangement, and it is what makes the lease something the licensing system recognises rather than a private understanding between two people.

Ownership documentation is provided for the vehicle. Because a lease transfers a limited interest rather than the plate, ownership remains where it was, and the City wants that position on the record.

A Safety Standards Certificate less than 36 days old when submitted establishes the mechanical condition of the vehicle at the start of the arrangement. Finally, a Certificate of Insurance is submitted by the insurance broker directly to the City's taxi licensing email address rather than being handed in by the applicant, which is the same practice used for taxi cab owner licences.

Zoning and premises requirements

Zoning plays no part in a lease agreement. The subject of the arrangement is an interest in a licence and a vehicle, and neither has a zoning designation.

Zoning applies to premises, which in the taxi system means the brokerage that dispatches the cab. Its address is dealt with through the taxi cab broker licence, which asks for a Zoning Verification Certificate or an open building permit.

So no zoning certificate, no addendum and no zoning fee arise on a lease file, whether the arrangement is new or being renewed.

Inspections and approvals

No City inspection is listed on the lease agreement checklist. What the file does depend on is the Safety Standards Certificate, which is a provincial mechanical inspection carried out at a licensed inspection station.

The 36-day currency rule is the point of it. Requiring a certificate less than 36 days old when submitted means the vehicle's condition is established at the start of the lease rather than being inherited from an inspection done for another purpose months earlier.

Separate vehicle inspections continue to apply under the taxi cab owner licence, where a Licensing Officer inspects the vehicle at application and before each renewal. A lease does not displace those obligations, because it does not change who owns the plate.

How much does it cost?

A new lease agreement carries a processing fee and a lease agreement fee. HST applies to the processing fee; the lease agreement fee itself is not taxed.

Renewing the lease costs the lease agreement fee alone, with no processing fee, provided the completed Lease Renewal Form arrives on time.

Lateness is handled differently here than elsewhere in the system. Instead of the licence re-instatement fee used for expired licences, a late lease renewal carries a late administrative lease renewal fee, made up of a late fee plus HST.

One condition sits above all of this: before any plate transfer, licence renewal or new or renewed lease, outstanding fees for service and court fines must be paid. The Issuer of Licences may refuse to issue a licence where they have not been. All amounts are set in the City's fee schedule and confirmed at the time of application.

How to apply

Agree the arrangement with the plate owner and complete the City's Lease Agreement form together. Both sides of a limited interest transfer are recorded on it.

Gather ownership documentation for the vehicle, and book the safety inspection so the Safety Standards Certificate will be less than 36 days old when it is submitted.

Instruct the insurance broker to send the Certificate of Insurance directly to the City's taxi licensing email address. This is the step most often left until last, and the file cannot complete without it.

Submit the package and pay the processing fee and lease agreement fee. Confirm at the same time that no outstanding fees for service or court fines are attached to either party, since those will block a new or renewed lease.

Renewals and staying compliant

Renewing a lease is simpler than starting one. A completed Lease Renewal Form must be submitted, and the lease agreement fee is paid again.

Deadlines still matter. A late renewal attracts a late administrative lease renewal fee, which is charged as a late fee plus HST rather than as the licence re-instatement fee that applies to expired licences.

Outstanding fees for service and court fines have to be cleared before a lease is renewed, in the same way as they must be before a plate transfer or a licence renewal.
