Terms of Service

Welcome to Permits2Go (the "Service", "Platform", or "SaaS"). These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you", "User", or "Customer") and Permits2Go ("we", "us", or "our"), concerning your access to and use of our permit automation platform.
By accessing or using the Service, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Service and must discontinue use immediately.
1. Access, Subscriptions, and Permitted Use
- License Grant: Subject to compliance with these Terms and timely payment of any subscription fees, Permits2Go grants you a limited, non-exclusive, non-transferable, revocable right to access and use our online software platform.
- User Accounts: You are responsible for safeguarding your login credentials. Account credentials cannot be shared across multiple individuals or external parties. You are solely responsible for all activities occurring under your account.
- Prohibited Activities: You agree not to:
- Decompile, reverse engineer, or attempt to extract the source code of the Platform.
- Use the Service to transmit malicious code, viruses, or automate data collection in a manner that degrades system performance or bypasses our intended browser-automation API protocols.
2. Platform Nature and No Legal/Municipal Guarantee
- Automation Utility Only: Permits2Go provides software automation tools to help streamline document compilation and submission processes for municipal building codes, zoning bylaws, and property permits.
- RPA Agent Submissions Are in Beta: The RPA Agent — the automation feature that submits applications directly to municipal portals on your behalf — is currently offered in beta. Beta features are provided "as is" and "as available"; they may be modified, suspended, or discontinued at any time and may produce errors, interruptions, or incomplete submissions. You are responsible for verifying that any submission made by the RPA Agent was received by the municipality and is accurate and complete before relying on it.
- No Municipal Affiliation: Permits2Go is an independent private platform. It is not affiliated with, endorsed by, or an official partner of any municipality (such as Toronto, Mississauga, or Hamilton), nor any third-party government submission portals.
- No Legal or Professional Advice: Content, workflows, or automated suggestions provided by the Platform do not constitute architectural, engineering, accounting, or legal advice. You are entirely responsible for ensuring your data packages comply with the local Ontario Building Code and specific municipal bylaws.
- No Guarantee of Approval: Permits2Go automates the delivery and formatting of data as directed by you. We do not guarantee that any municipality will accept, review, or approve your submitted permits.
3. Customer Data and Document Management
- Ownership of Data: You retain all intellectual property rights in the documents, blueprints, property identifiers, and personal data you input or upload to the Platform ("Customer Data").
- License to Us: You grant Permits2Go a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display your Customer Data solely to provide, maintain, and optimize the Service for you.
- Document Signatures: If the Service integrates digital document execution services (such as DocuSeal or Cloudpermit APIs), you acknowledge that your digital confirmation through our interface constitutes a valid, legally binding signature under the Ontario Electronic Commerce Act, 2000.
- Data Backup: While we utilize secure cloud data storage protocols, you are expected to maintain an independent backup copy of all data and applications uploaded to the Platform. Permits2Go is not liable for data loss caused by unexpected carrier or infrastructure network outages.
4. Fees, Billing, and Renewals
- Subscription Models: Fees are billed on a recurring subscription basis (monthly or annually) as outlined during your account registration.
- Automatic Renewal: Subscriptions automatically renew for successive terms under the same conditions unless canceled by the user at least thirty (30) days prior to the next billing cycle.
- Taxes: All fees are exclusive of applicable federal and provincial taxes (including Ontario HST), which will be calculated and added to invoices where applicable.
- Refund Policy: Except as expressly required by applicable Ontario consumer protection laws or explicitly stated at purchase, all subscription fees are non-refundable.
5. Intellectual Property Rights
- Our Property: The structural architecture, user interfaces, branding, software code, algorithms, visual design elements, and logos of Permits2Go are owned exclusively by us and are protected by Canadian and international copyright and trademark laws.
6. Limitation of Liability and Disclaimers
- "As-Is" Service: The Service is provided on an "As-Is" and "As-Available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability or fitness for a particular municipal purpose.
- Limitation Cap: In no event shall Permits2Go, its directors, or employees be liable for any indirect, incidental, special, or consequential damages (including loss of profits, construction delays, or project penalties).
- Maximum Liability: Our aggregate liability to you for any cause whatsoever will at all times be limited to the total amount paid by you to Permits2Go during the three (3) month period immediately preceding the event giving rise to the claim.
7. Governing Law and Jurisdiction
These Terms and your use of the Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Toronto, Ontario.
8. Modifications to Terms
We reserve the right to update or modify these Terms at any time. We will notify you of any material changes by updating the "Last Updated" date or through in-app notifications. Your continued use of the Platform after changes are published constitutes acceptance of the revised Terms.
