A pawnbroker is not simply a shop that buys used goods. Under Schedule 5 of By-law 07-170, a pawnbroker takes goods by way of pawn or pledge as security for money it lends. That lending relationship is what puts this business in its own licence class, and it is why the City asks for a security deposit that no other second-hand licence requires.
The City of Hamilton lists this under its “Establishments” category: “Pawnbroker is a person/business that takes by way of pawn or pledge any good for the repayment of money lent thereon.”
Who needs this licence?
The definition is about lending, not retail. A pawnbroker is a person or business that takes any good by way of pawn or pledge for the repayment of money lent on it. The customer is borrowing against an item and expects to be able to redeem it; that is a different transaction from selling something outright.
That distinction decides which licence you need. A shop that buys used goods and resells them is a second hand shop. A business that buys jewellery or precious metals in order to smelt them is a precious metals and jewellery dealer. A business that lends money against pledged goods is a pawnbroker, and if you do more than one of those things, ask Licensing and By-law Services which licences apply before you open.
You need a Criminal Records and Judicial Matters Check from the police service board in the city where you live, dated within 36 days of your application. Third party clearances are not accepted.
You also have to lodge a security deposit payable to the City of Hamilton. It is held until the closure or sale of the business and then refunded, which makes it a returnable commitment rather than a sunk cost, but you still need the money available at the outset.
What documents do you need?
The file starts with the completed application form and a business registration, corporate profile or master business licence dated within one year of your application.
The Zoning Verification Certificate confirms the address is zoned for the use. The Criminal Records and Judicial Matters Check covers the applicant, and the by-law is strict about it: it has to come from the police service board where you live and be dated within 36 days, and third party clearances are refused.
The item that is specific to pawnbroking is the security deposit payable to the City of Hamilton. It is held until the business closes or is sold, at which point it is refunded. Plan your opening cash flow around it, because it is not a fee that disappears into the licensing process.
Because the business takes goods from members of the public as security, keep the by-law's own requirements for the trade in view as well. Schedule 5 sets out the definition, requirements and restrictions that apply to a pawnbroker, and the licensing team will confirm what your obligations are when your licence is issued.
Zoning and premises requirements
A Zoning Verification Certificate is required and confirms that the zoning at the address permits the use. It is tied to the property, so it is the first check to make when you are choosing a location.
If the same category of business was previously licensed at the address within one year, a Zoning Addendum may be completed instead of the full certificate. Pawn shops often occupy premises that have been through the same use before, so this route is worth asking about.
No premise plan or site plan appears on this licence's checklist. The zoning question here is about the address and the use, not about how you lay out the interior.
Inspections and approvals
A parking inspection is the inspection required, and the request for it is circulated by the Licensing Team after your application has been received.
It looks at the parking serving the premises against what the site requires. Since a pawn shop draws walk-in customers throughout the day, this is a practical check rather than a formality.
No fire or health inspection appears on this checklist, so the parking inspection is the only visit tied to the licence itself.
How much does it cost?
A new application carries a processing fee, the licence fee and the parking inspection fee. HST applies to the processing fee and the inspection fee; the licence fee is not subject to HST.
Zoning verification, or the addendum where you qualify for it, is charged on top and carries no HST. The fee schedule shows an application total with the zoning line and one without it.
The security deposit is separate from all of that. It is not a fee: it is payable to the City of Hamilton, held while you operate, and refunded when the business closes or is sold. Budget for it as working capital you cannot use.
Renewal is charged as the licence fee. A licence that lapses has to be reinstated and reinstatement carries its own fee with HST. All amounts come from the City's fee schedule and are confirmed at the counter.
How to apply
Confirm the licence class first. If your business lends money against pledged goods, pawnbroker is the right class; if it only buys and resells, look at the second hand shop licence instead.
Request the Zoning Verification Certificate for the address, complete the application form, and obtain a business registration or corporate profile dated within the past year.
Order the Criminal Records and Judicial Matters Check from the police service board where you live, timed so it is still within 36 days when you file.
Arrange the security deposit payable to the City of Hamilton. Once the application is received, the Licensing Team circulates the request for the parking inspection.
Renewals and staying compliant
Declarations A and B both have to be completed at renewal. There is no requirement on this licence to attend in person with photo identification, which is a difference from the personal licences elsewhere in the by-law.
The renewal charge listed is the licence fee. No repeat inspection fee appears in the renewal structure for this class.
Your security deposit stays with the City while the business operates. It is refunded on closure or sale of the business rather than at any renewal point, so do not budget for it coming back mid-licence.
Renew before the expiry date, because a late licence attracts a reinstatement fee with HST on top of the ordinary renewal cost.
