Hotel and Motel Licence in Hamilton: Requirements and How to Apply

The Schedule 3 licence for commercial accommodation, where the health inspection is conditional and fire and parking are not.

Hotels and motels are licensed under the same Schedule 3 definition as a bed and breakfast, but the City treats them as a different kind of building. Fire and parking are inspected as a matter of course, while the health inspection only comes into play if there is an eating establishment or a pool on site. That single conditional line is what shapes the cost and the timeline of your application.

The City of Hamilton lists this under its “Establishments” category: “A premises where one or more bedrooms are offered to members of the public who may pay for the use of a bedroom on any basis for 7 days or less and includes an inn but does not include a lodging house.”

Who needs this licence?

Schedule 3 applies to a premises where one or more bedrooms are offered to members of the public who may pay for the use of a bedroom on any basis for seven days or less, including an inn. Read literally, that covers everything from a roadside motel to a full-service downtown hotel. There is no room-count threshold in the definition.

It does not cover a lodging house. If people are lodged in rooms without their own kitchen facilities and the arrangement is residential rather than transient, that is a lodging home under Schedule 9, with a Certificate of Compliance and a per-resident element to the fee.

Because the definition is shared with bed and breakfasts, the practical question is which heading your operation belongs under. Apply as a hotel or motel where the building exists to sell rooms as its main business rather than as a house where the operator also lives and serves guests breakfast. The consequence of picking the right heading is real: the checklist here has no guest registration form, and the health inspection is conditional rather than automatic.

The guide places no council-approval step or licence cap on this category. What gates the file is the inspection round, not a quota.

What documents do you need?

The core of the package is the completed Business Licence Application Form and a valid business registration, corporate profile or master business licence dated within one year of the application. For a property held by a numbered company, file the corporate profile.

Zoning comes next: a Zoning Verification Certificate for the property, or a zoning addendum where the same category of business was licensed at that address within the past year. Change-of-ownership applications for an existing hotel are the classic addendum case.

You also file a Criminal Records and Judicial Matters Check from the police service board where you live, dated within 36 days of the application. Third party clearances will not be accepted, so use the police service directly.

The technical documents follow. A detailed site plan shows the establishment on the property with setbacks to all property lines and the location, dimensions and driveway access to required parking, which matters more here than on a small residential file because guest parking demand is the whole reason the parking inspection exists. A certified electrician inspection or ESA certificate confirms compliance with the Ontario Electrical Safety Code. A premise plan drawn to scale depicts parking and queuing areas, walkways, smoking areas, patios, seating areas, offices, cloak rooms, dance and disc jockey areas, kitchen facilities, bar areas, washrooms, storage areas and entrances and exits, and carries the fire evacuation plan with exits, smoke detection and fire extinguishers.

Note what is not on this list. There is no guest registration form sample here, and nothing about the premise plan being annotated room by room. The hotel and motel package is a building-scale package, not a household one.

Zoning and premises requirements

The licence attaches to a property, so zoning is verified at the address. You need a Zoning Verification Certificate confirming the accommodation use is permitted where the building stands.

Where the same category of business was licensed at the address within the previous year, a zoning addendum may be completed instead of a fresh certificate. That route is worth checking first when you are buying an operating motel rather than starting a new one, because it can save a full verification cycle.

The premise plan must be drawn to scale. It is not just a floor layout: the City expects to see parking areas, queuing areas, walkways, smoking areas, patios, seating areas, offices, cloak rooms, dance areas, disc jockey areas, kitchen facilities, bar areas, washrooms, storage areas and entrances and exits, plus the fire evacuation plan. If your property includes a restaurant or lounge, those spaces belong on the same drawing, since they also drive whether the health inspection line applies.

Inspections and approvals

Once your application is received, the licensing team circulates the inspection requests. You do not chase the inspectors individually.

  • Fire inspection. Unlike the bed and breakfast schedule, this is not limited to new applications. Expect the fire side to look at exits, smoke detection, extinguishers and the accuracy of your filed evacuation plan across the whole building.
  • Health inspection. This is the conditional one. The fee schedule attaches it to properties where there is an eating establishment or a pool, which is why two hotels of the same size can face different application costs.
  • Parking inspection. The inspector checks the parking shown on your site plan against what is actually provided, including dimensions and driveway access.

The conditional health inspection is the single most useful thing to work out before you apply. If you operate a restaurant, breakfast service counted as an eating establishment, or a swimming pool, plan for it on both the application and the renewal. If you do not, that line drops off.

How much does it cost?

The application total is assembled from a processing fee, the licence fee, a fire inspection fee and a parking inspection fee. Those four make up the base subtotal shown in the guide.

Two lines sit outside that base. The health inspection fee is added only where there is an eating establishment or a pool, and the zoning verification or addendum fee is added where zoning has to be confirmed. The guide prints a total without zoning and a second total with it, which is how you can tell those are genuinely optional lines rather than hidden ones.

HST applies unevenly. The processing fee and the inspection fees are shown with HST added to a set fee, while the licence fee and the zoning verification line are shown without it.

At renewal the schedule narrows to the licence fee, with the health inspection again only if there is an eating establishment or pool. A licence that is allowed to lapse carries a reinstatement fee. The City sets every amount in its fee schedule and confirms them with you when you apply.

How to apply

Settle the zoning question first. For a purchase of an operating property, ask whether the addendum route is open to you before ordering a full Zoning Verification Certificate.

While zoning is in progress, get the drawings underway. The scaled premise plan and the detailed site plan are the long-lead items, particularly on a multi-building motel site where parking dimensions and driveway access have to be measured rather than estimated.

Arrange the certified electrician inspection or ESA certificate, refresh your business registration or corporate profile if it is over a year old, and order your criminal records and judicial matters check close to submission so it is within the 36-day window.

File the completed application form with the package and pay the processing, licence and inspection fees, adding the health inspection fee if your property has an eating establishment or a pool. The licensing team then circulates the fire, health and parking inspection requests. Address any deficiencies, and the licence is issued.

Renewals and staying compliant

Declarations A and B have to be completed at each renewal. They are the mechanism by which you confirm the operation and the premises still match what was licensed.

The renewal schedule is short: the licence fee, plus a health inspection only if there is an eating establishment or a pool. That conditional line follows the property, so if you add a restaurant or open a pool partway through a licence term, expect your renewal to look different from the previous year.

Renew on time. A late licence carries a reinstatement fee, which is charged on top of the renewal itself. If you have renovated, changed the room mix or altered parking since your plans were filed, update the drawings before renewal rather than waiting for an inspector to find the discrepancy.
